- Can a landlord increase rent before the agreement expires? Generally no — the rent agreed in a running agreement holds until it ends, unless the agreement itself sets out an increase.
- How much security deposit is normal in India? It varies sharply by city — one to three months' rent in most of the country, and far higher in parts of Bengaluru.
- Can a landlord keep the security deposit for repairs? For damage beyond normal wear and tear, yes — but not for ordinary ageing, and not without accounting for it.
- Is registering a rent agreement mandatory? For a term of 12 months or more, registration is generally required. Shorter agreements usually are not — which is why 11-month agreements are everywhere.
- Why are rent agreements in India usually 11 months? Because 12 months or more triggers mandatory registration — 11 months keeps the paperwork and cost down.
- What is stamp duty on a rent agreement, and who pays it? A state tax on the agreement itself, calculated from rent, deposit and term — usually paid by the tenant, though the agreement decides.
- What documents should a landlord collect from a tenant? Photo ID, address proof, something confirming employment or income, and photographs — plus police verification where the state requires it.
- What should a rent agreement include? The parties, the property, rent and deposit, term and notice, who pays what, and how it ends — in writing, signed by both sides.
- How much notice does a tenant or landlord have to give? Whatever the agreement says — most commonly one to three months, and the same obligation usually runs both ways.
